1. Acceptance of Terms

By creating an account, accessing, or using Geesly, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Eligibility

To use Geesly, you must meet the following requirements:

• You are at least 18 years old.
• You have the authority to enter into this agreement under the laws of your jurisdiction.
• You have not previously been suspended or removed from Geesly.
• You represent that you have not been convicted of, nor are you subject to any court order relating to, assault, violence, sexual misconduct, or harassment.
• You are not prohibited by law from using our services.

3. User Accounts

To access certain features, you must create an account. You agree to provide accurate, current, and complete information. You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.

You may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. You must notify us immediately of any unauthorized use of your account.

4. Community Rules & Prohibited Conduct

Geesly has a Zero Tolerance Policy for objectionable content and abusive users. You agree NOT to:

• Harass or Bully: Intimidate, stalk, or harass any person on or off the Service.
• Hate Speech: Post content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.
• Sexual Content: Post pornography, nudity, or sexually explicit content.
• Fraud & Spam: Solicit money, use the Service for commercial purposes, or spam other users.
• Impersonation: Impersonate any person or entity or post images of another person without their permission.
• Illegal Activity: Use the Service for any illegal purpose or violate any laws.
• Minors: Attempt to contact or solicit information from minors.
• Bots/Automation: Use bots, scripts, or automated methods to access the Service.
• Scraping: Extract data from the Service using automated means.
• Reverse Engineering: Decompile, disassemble, or reverse engineer any part of the Service.

We reserve the right to investigate and terminate your account without a refund if you violate these rules.

5. Content Rights

Your Content

• You retain ownership of all content you post on Geesly (photos, messages, profile information)
• By posting content, you grant Geesly a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the service
• This license continues for up to 90 days after account deletion to allow for cached or backup copies, after which your content will be permanently deleted
• You represent that you own or have the necessary rights to all content you post

Geesly's Content

• Geesly owns all rights to the service, including design, features, graphics, and code
• You may not copy, modify, or create derivative works of our service
• Our trademarks and logos may not be used without permission

6. Content Moderation

Geesly reserves the right to:

• Review and monitor user content and activity
• Remove content that violates these Terms without notice
• Suspend or terminate accounts that violate these Terms
• Report illegal activity to law enforcement
• Preserve content for legal proceedings

We do not pre-screen content but rely on users to report inappropriate content and behavior.

7. Rating and Matching System

• Users rate profiles from 1-5 stars, affecting visibility and match potential
• A rating of 5 stars indicates a "like" and may result in a match if reciprocated
• Users accumulate a score based on ratings received
• You may only see profiles within your specified preferences
• The algorithm determines which profiles you see based on multiple factors
• Geesly does not guarantee matches or results

8. Virtual Currency and Purchases

• Geesly may offer premium features for purchase
• All purchases are final and non-refundable unless required by law
• Prices are subject to change with notice
• Premium features are subject to separate terms
• You are responsible for any charges incurred through your account
• Virtual currency (Corns) have no monetary value and cannot be exchanged for cash
• All purchases are processed through third-party app stores (Apple, Google)

9. Subscriptions and Auto-Renewal

If you purchase an auto-recurring subscription:

• Your payment method will be charged automatically at the start of each billing period
• You can cancel anytime through your app store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods
• Prices may change with 30 days' notice

10. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent, illegal, or harmful behavior
• Receive multiple user reports
• Remain inactive for an extended period

You may request account deletion at any time by contacting geeslyhelp@gmail.com. Upon termination, your access to the service will cease, but certain information may be retained as described in our Privacy Policy. We reserve the right to terminate or suspend service to any user at any time without notice.

11. Disclaimers

GEESLY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of content
• Uninterrupted or error-free service
• Security of your data or communications
• Outcomes from using the service (matches, relationships, etc.)

We do not conduct background checks on users. You are responsible for your own safety when meeting people through Geesly. We make no guarantees about match quality, success rates, or relationship outcomes. The Service may contain errors, bugs, or inaccuracies.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEESLY SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or errors
• User content or conduct
• Third-party actions or content
• Any damages arising from your use of the service

Our total liability to you shall not exceed the amount you paid to Geesly in the past 12 months, or $100, whichever is lesser.

13. Indemnification

You agree to indemnify, defend, and hold harmless Geesly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person
• Your content posted on the Service

14. User Responsibility and Safety

YOU ARE SOLELY RESPONSIBLE FOR:

• Verifying the identity and background of other users
• Your interactions with other users, both online and offline
• Your physical safety when meeting users in person
• Protecting your personal information

SAFETY RECOMMENDATIONS:

• Never send money to other users
• Meet in public places for first meetings
• Tell friends/family when meeting someone new
• Trust your instincts - if something feels wrong, it probably is
• Report suspicious behavior immediately
• Do not share financial information

15. Purchases and Subscriptions (Detailed)

Geesly may offer products and services for purchase ("In-App Purchases") through the App Store, Google Play, or other payment platforms authorized by Geesly.

A. Subscriptions & Auto-Renewal

If you purchase an auto-recurring periodic subscription, your Payment Method will continue to be billed for the subscription until you cancel. After your initial subscription commitment period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing.

B. Virtual Items

You may purchase a limited, personal, non-transferable, non-sublicensable, revocable license to use "virtual items" (e.g., Corns, Boosts). Virtual items are not redeemable for money or monetary value from us or any other entity.

C. Refunds

Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. Refunds are handled exclusively by the platform (Apple or Google) through which you made the purchase, not by Geesly.

16. Intellectual Property

All intellectual property rights in the Service, including but not limited to:

• Software, code, and algorithms
• Design, layout, and user interface
• Trademarks, logos, and brand elements
• Original content created by Geesly

are owned by Geesly or its licensors. You may not use, copy, modify, or distribute any of our intellectual property without explicit written permission.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable law. You agree to resolve disputes through binding arbitration as described below, or in a court of competent jurisdiction.

18. Dispute Resolution and Arbitration

• Binding Arbitration: Most disputes will be resolved through binding arbitration rather than in court.
• Class Action Waiver: YOU AND GEESLY AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
• Small Claims Court: You may bring claims in small claims court if they qualify.
• 30-Day Right to Opt Out: You have 30 days from account creation to opt out of arbitration by emailing geeslyhelp@gmail.com.

19. Digital Millennium Copyright Act (DMCA)

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with:

• A physical or electronic signature of the copyright owner
• A description of the copyrighted work
• A description of where the material is located on the Service
• Your contact information
• A statement of good faith belief that use is not authorized
• A statement under penalty of perjury that the information is accurate

20. Apple App Store Additional Terms

If you use Geesly on an iOS device, you acknowledge that:

• These Terms are between you and Geesly only, not with Apple
• Apple is not responsible for the Service or its content
• Apple has no obligation to furnish maintenance and support services
• Apple is not responsible for addressing claims relating to the Service
• In the event of any third-party claim that the Service infringes intellectual property rights, Geesly, not Apple, will be responsible
• Apple and its subsidiaries are third-party beneficiaries of these Terms

21. Google Play Store Additional Terms

If you download the app from Google Play, you agree to the Google Play Terms of Service and acknowledge that Google is not liable for any claims related to the app.

22. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

23. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

24. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without your consent.

25. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

26. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and Geesly.

27. Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or obligation to you.

28. Survival

Provisions that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive termination of these Terms.

29. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of Geesly after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service.
